This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2011, which requires publishing the rules, privacy policy, and Terms of Use for access or usage of domain name [www.hellomart.in] (“Website”), including the related mobile site and mobile application (hereinafter referred to as the “Platform”). The Platform is owned by Hello Mart Private Limited, a company incorporated under the Companies Act, 1956, with its registered office at In Front of Manoranjan Park, Birla Nagar Road, Hazira, Gwalior. The parent company of Hello Mart is Big Haat Bazaar.

Your use of the Platform and its services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform. By using the Platform, you contract with Hello Mart Private Limited, and these terms and conditions, including the policies, constitute your binding obligations with Hello Mart.

"You" or "User" shall mean any natural or legal person who has agreed to become a buyer on the Platform by providing Registration Data while registering on the Platform.

"We", "Us", "Our" shall mean Hello Mart Private Limited.

ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORM indicates your agreement to all the terms and conditions under these Terms of Use. By impliedly or expressly accepting these Terms of Use, you also accept and agree to be bound by Hello Mart's Policies (including but not limited to the Privacy Policy) as amended from time to time.

Transactions on the Platform are available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. If you are a minor (under the age of 18), you may use the Platform or access content on the Platform only under the supervision and with the prior consent/permission of a parent or legal guardian.

If you use the Platform, you are responsible for maintaining the confidentiality of your Display Name and Password and for all activities that occur under your account. Your mobile number and email address are your primary identifiers. Ensure they are up to date to avoid suspension or termination of your account.

By using the Platform or communicating with us electronically, you consent to receive communications from us electronically via email, SMS, or other means.

Hello Mart acts as a platform to enable Buyers and Sellers to conduct transactions. All commercial/contractual terms, including price, shipping costs, payment methods, warranties, and after-sales service, are agreed upon between the Buyer and Seller alone.

Hello Mart is not responsible for any non-performance or breach of any contract between Buyers and Sellers. In case of order cancellation by the Seller, any amounts paid by the Buyer will be refunded.

In cases of undelivered or lost orders, the entire order amount will be refunded. Partial order cancellations will result in proportional refunds.

Select products may be eligible for business purchases with GST input tax credit. Ensure that the delivery address matches the registered business address when using GSTIN for invoices. Hello Mart and Sellers are not liable for incorrect GSTIN details provided by you.

You agree to indemnify and hold Hello Mart harmless from any claims arising out of your use of the Platform or violation of these Terms of Use.

Hello Mart does not guarantee uninterrupted or error-free operation of the Platform. The Platform is provided "as is" and "as available."

These Terms of Use and any disputes arising from your use of the Platform will be governed by the laws of India. The courts at Gwalior shall have exclusive jurisdiction.

You agree to use the Platform for lawful purposes only and not engage in any activities that disrupt or harm the Platform or its users.

Prices for products are as listed by Sellers. In case of pricing errors, Hello Mart reserves the right to refuse or cancel orders.

Promotions, contests, and scratch card contests will be governed by specific rules. For the daily scratch card contest, users participate by paying 1% of the product's MRP. Refunds or cancellations are permitted up to 1 hour before the contest.

1. Order Cancellations: Orders can be canceled before dispatch. Refunds will be processed within 7 working days.

2. Return Policy: Products eligible for return will be refunded after a quality check.

3. Non-Refundable Services: Digital goods or services may not be eligible for refund unless specified.

4. Cancellation by Hello Mart: Orders may be canceled due to availability issues or fraud. Full refunds will be processed in such cases.

All content on the Platform is the property of Hello Mart or its content suppliers. Reuse of content is prohibited without written consent.

Hello Mart is not responsible for the content of Linked Sites. These links are provided as a convenience and do not imply endorsement.

Hello Mart reserves the right to terminate your access to the Platform without notice for any violation of these Terms of Use.

In no event shall Hello Mart's total liability exceed the amount paid by you in the last six months.

If any dispute arises between you and Hello Mart during your use of the Platform or thereafter, the dispute shall be resolved in accordance with the laws of India. The courts at Gwalior, Madhya Pradesh, shall have exclusive jurisdiction in any proceedings arising from this agreement. Hello Mart reserves the right, at its sole discretion, to modify or replace these Terms of Use at any time. Any changes will be effective immediately upon posting to www.hellomart.in. Your continued use of the Platform after such changes signifies your acceptance. We recommend reviewing the Terms of Use regularly to stay informed of any updates.

Hello Mart strives to provide accurate descriptions of products on the Platform. However, we do not warrant that product descriptions, photographs, or other content is error-free. If a product is not as described, you may return it in accordance with our return and refund policy. Availability of products may vary depending on stock, and Hello Mart will notify you and refund the full amount if a product becomes unavailable after an order is placed.

We offer various payment options for a convenient shopping experience, including:

Orders are confirmed only after successful payment processing. For failed transactions, contact our customer support. Refunds will be processed in line with our refund policy.

Hello Mart uses third-party payment gateways for all transactions. By using the Platform, you agree to the terms of these providers. Hello Mart is not liable for issues caused by third-party services, but we will assist you in resolving disputes with them.

You expressly agree that your use of the Platform is at your sole risk. Hello Mart provides the Platform on an "as is" and "as available" basis. We make no guarantees about the reliability, accuracy, or availability of the Platform. Furthermore, we do not guarantee that the Platform will be error-free or free from harmful components.

You agree to indemnify and hold Hello Mart, its affiliates, and their employees harmless from any claims, losses, or damages resulting from:

1. Your use of the Platform;

2. Your breach of these Terms of Use;

3. Any disputes between you and third-party providers (e.g., sellers or payment gateways);

4. Violations of laws or third-party rights.

Hello Mart will not be liable for delays or failures due to events beyond its control, such as natural disasters, pandemics, war, strikes, government actions, or technical failures.

You agree to comply with all applicable laws and regulations concerning your use of the Platform.

By using the Platform, you consent to receiving communications from Hello Mart, including notifications, updates, and promotional materials. You may opt-out of certain communications, but this may limit your access to some features.

By using the Platform, you acknowledge that electronic submissions constitute your agreement to transactions and legal agreements.

These Terms of Use and any disputes shall be governed by the laws of India. Any proceedings will take place in Gwalior, Madhya Pradesh.

If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable by any court of competent jurisdiction, such provision shall be deemed severed from the remaining provisions of these Terms of Use, which shall continue in full force and effect. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions. If necessary, the severed provision will be replaced with a valid and enforceable provision that reflects the intent of the original provision as closely as possible.

Account Management You are responsible for maintaining the confidentiality of your account information, including your display name, password, and any other details necessary to access the Platform. You agree to notify Hello Mart immediately of any unauthorized use of your account or any breach of security. Hello Mart will not be liable for any loss or damage arising from your failure to safeguard your account credentials.

Intellectual Property Rights All content available on the Platform, including but not limited to text, graphics, logos, images, data compilations, software, and other materials, is the property of Hello Mart, its licensors, or third-party content providers and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-transferable, non-exclusive license to access and make personal use of the Platform, but not to download (other than page caching) or modify it, or any portion of it, without our express written consent. Unauthorized use of the content may result in legal action.

1. Eligibility: Users must be 18 years or older and residents of countries where Hello Mart operates to participate in the scratch card contest.

2. Booking and Participation: Participation in the scratch card contest requires the payment of 1% of the product's MRP as a booking amount.

3. Cancellation and Refunds: Bookings can be canceled up to 1 hour before the scratch card contest starts. Refunds for canceled bookings will be processed within 7 working days to your Hello Mart wallet or the original payment method.

4. Scratch Card Contest Process: Results are generated randomly and cannot be appealed. Winners will be notified via the Platform.

5. Non-Winning Participants: Non-winners will receive a voucher equivalent to twice the booking amount, valid for 30 days.

6. Product Availability: In cases where a booked product becomes unavailable, Hello Mart will provide a full refund of the booking amount.

7. Winners' Liability: Winners are responsible for paying any applicable taxes and duties related to the prize.

8. Winner's Choice: Winners may choose to receive the product they booked or opt for its monetary value credited to their Hello Mart wallet.

9. Wallet Balance: For non-winners, the booking amount will be converted into wallet credits worth twice the original booking amount, which can be used for future purchases.

10. Modification of Terms: Hello Mart reserves the right to modify or terminate the scratch card contest without prior notice.

Termination Hello Mart reserves the right to suspend or terminate your access to the Platform without notice or liability for any reason, including but not limited to a breach of these Terms of Use, fraud, misuse of the Platform, or inactivity. Upon termination, your right to use the Platform will immediately cease, and any remaining wallet balance or vouchers may be forfeited.

Feedback and Suggestions By submitting feedback or suggestions to Hello Mart, whether solicited or unsolicited, you grant Hello Mart the right to use such feedback without any obligation to compensate you. You agree that Hello Mart may use the feedback for any purpose, including improving the Platform, without any restriction or liability. You acknowledge that any feedback or suggestions you provide are non-confidential and non-proprietary.
